關於貿易二三事 - 貿易糾紛之湖貨物遇劫

 
怎麼一回事呢??
在來來回回糾纏無數回合之後,
客人那方只有一種感覺就是 "客人已經氣急攻心甚麼都不管了就是要賴給你"
我家這方也只有一種感覺就是"小氣拔剌只進不吐完全沒有憐憫之心"


在說故事之前先來說說這家公司背景
(#^@^# 敝人在下小的待的公司簡稱甲方 / 客戶簡稱乙公司)

甲方身處台灣                                              乙方身處墨西哥
------------------------------------------------------------------------------------------------------
☆甲方認為是以FOB+待付運費&保險費   ★乙方認為交易條件是CIF保險保到她家門口,保險甲方幫忙
                                                                 買,所以出事了我們要想辦法找保險公司吐出錢來)

☆甲方認定貨物在乙方國家的陸地上被    ★乙方認定他們已經有夠可憐的了多一筆貨還要多課 US$
劫的不關我家的事,但是老闆高抬貴手      3,000的進口稅+ 多一筆訂單費用+多出的運費+額外的
悲天憫人出1/3的運費                              保險費
       

           

故事是這樣來的.... (為呈現原汁原味完全以原文表示)
p.S. 以下為墨西哥人VS 台灣人的對話,內容以溝通為要英文看得懂就好囉!
 
Story 1  - 天外飛來一封因為貨物被劫要求幫忙分攤損失的信

Dear Nicole
     We have a very dificult situation, today we recieve an announcement that the merchadise of the invoice MAX-081106 was stolen in then way from manzanillo to guadalajara , we know it has an insurance but we have to cover some extra charges.
 
FOB:                            USD$8491.15
SEA FREIGHT:          USD$  465.00
INSURANCE:             USD$     30.00
-------------------------------------------------------- 
TOTAL PAID:              USD$8992.15
 
IMPORT TAXES  &    USD$3000.00
EXTRA FREIGHT CHARGES
--------------------------------------------------------  
TOTAL                        USD$11992.15
 
We need our support with this situation and see if you can try to recover the insurance of this freight.
There in your country to help us somehow.
 

First i want to ask you that you repeat the order as soon a possible because we have this merchandise
compromised with a sale to our goverment and we have to deliver it.

...怎麼這樣事情都快做不玩了還來亂....又不是不知道我們家老闆以保守穩健為名,不該他出的他會出一些已經要放鞭炮了!! 
左等等又等等在經過一個禮拜的等待期客人先行簽回確認不含運保費的FOB價格


待老闆回來後從原本的不悅"不是我們丟貨的為什麼要我們出??到願意付1/3的運費;同時特助也答應我方吸收保險費


就在以為就此天下太平,堯舜禹湯只要客人再回傳簽回的訂單就此搞定
沒想到一切都是我太天真啦!!
客人說他老闆非常的難過同時也再次強調他們買的是CIF term,所以他們有權利要求保險公司償還損失


可是明明CIF是港口到港口這段的保險
縱使我們保的是全險
在貿易條款之解釋規則(Incoterms 2000)中詳列了賣方&買方所要承擔的責任
在此節錄如下︰

CIF是Cost, Insurance, Freight三個字之字母簡寫,即貨價之計算以貨物之成本,加上保險費,再加上運費為基礎,貨物須依買賣合約運到目的地交貨


依CIF條件,或價計算雖 已到達目的地為基礎,賣方因在貨價中,已預收保險費,因此賣方須在貨物離港前,辦理海上貨物運輸保險,在出口地洽購保險單後背書轉交買方持用,買方則不必在進口地辦理相關保險事宜,除非賣方之保險未能涵蓋全段之運輸保險,才有此必要由買方依需要自己洽購保險。


因買賣雙方未能言明保險之區間,賣方僅洽訂保險到進口國隻蟹或港為止之保險,又如買方之倉庫或工廠離卸貨港甚遠,期內路上之運送便須由買方自行承擔或自購陸上運輸保險加以保障,否則買方變容易產生保險上之漏洞而造成此段內陸運輸過程中無保險之狀況

所以基本上說來...客人就是不甘損失胡亂瞎吵就是要我們負擔運費又要保險公司陪
還要求我們多給幾份正本文件要跟墨西哥政府和墨西哥那方的保險公司要求賠償

這位客人哥哥每次見到他都帶著他漂亮老婆,
兩個全身穿戴著台灣都少人有的明牌
還曾經一度競選墨西哥市長

區區的運費US$ 465 + 保險費US$30
竟然也可以花那麼多時間來吵


Story 2  - 為了保住自己的薪水 + 區區小小的紅利後的反撲

Dear AXXX,

Well, go back to the insurance issue. You are right! You paid us by CIF amount. Under CIF, the seller delivers when the goods pass the ship’s rail at the port of shipment. Beside, the seller shall buy for the buyer the insurance that covers the risks of loss of or damage to the goods during the transport of the goods from the port of shipment to the port of destination.

 
Therefore, the risks of loss of or damage to the goods pass the buyer when the goods pass the ship’s rail at the port of shipment.


For insurance under AR (all risks), we can generalize the risks the assured may encounter during the sea transportation into the loss of or damage to the goods during port to port transportation.
As saying by insurance company, they said that they deal with causes regarding goods what lost on the way during inland transportation is quite comment. So they suggest buyers to buy the insurance named inland transportation insurance to cover the risks.


Our suggestion is following,
1)     Buy inland transportation insurance from your side.
2)     Buy inland transportation insurance from our side.


Hence, should we add one insurance “ inland transportation insurance” this time?

得到了看似耍賴的回覆

Dear Nicole
     My Boss its very upset about this situation again and he wants to tell you that you quote us in CIF from taiwan to Guadalajara, so you cant separate from the facts because it was on transit when it was stolen and it dont get  to the destination so we still dont recieve the merchandise, so its was stolen to you and its your duty to recover it  and replace it to us until you recover it in any manner, so we need you to cooperate with us to solve this sooner.

 
Maybe your boss wants to talk to Mr. Carlos Ortiz and get an agreement.

看來能幫忙的也只有自己了,我家老闆陷於瘋狂忙碌管理另一家公司同時參展回來沒多久又出去參展根本沒有時間,來這段時間也沒看過老闆親自寫信給哪個客人過,如果真的自己回了那老闆就降格為業務了吧!

所以...這位客人哥哥你就不要做夢了你只能跟我談啦!

Story 4  - 再度PK by Nicole


Dear AXXXX,

 
In drafting this letter after thinking overnight, we have recollected your patronage for over 8 years. We must point out that you are the most sensible and cooperative partner we have.


We hope by now that you will agree with our analysis. Our role is just like a manufacture, and over such tragedy, we should like to act as a helping role. This is because you have suffered the loss, which resulted from negligence only at your end. If we should show an attitude of indifference to this matter, we would be too cruel and not cooperative at all. Should we not be cooperative, we would surely lose such a nice partner who has been in the same boat with us for years.
 
At fist, would you please indicate the missing situation to us? We have no idea and just know that your merchandise got lost on the way. Would you please indicate by what way your merchandise got lost? Frankly speaking, you haven’t revealed any missing procedures to us and the only one clue that you showed in your letter of  17th December “merchandise of the invoice MAX-081106 was stolen on the way from Manzanillo to Guadalajara” We didn’t have any evidence can provide to insurance company, moreover, we bought “all risk” insurance for you without inland transportation insurance. These are the main reasons contributing to the impossibility of getting reimbursement from the insurance.


To deep regret is that the insurance company stands out as irresponsible due to uncompleted insurance buying. But as you know that we never ever bought inland transportation insurance to any partners during these 30 years business experience.



From all these points of view, we have decided to share with you, one third freight, i.e. US$155 ($465÷3) and insurance for US$30.

At this opportunity, one thing we must point out is that from a practical point of view, we have been supplying you with all supports at marginal price. Thus we have never made high profits from you, but have shown profound generosity. Moreover, we have made no mistake among all transactions as you clearly know.


Did you check with the tracking company who delivered your merchandise? Can you check whether your merchandise missed at the port?


All-risk insurance must be made on all out-going shipment. So when merchandise is missing on the way from port to port, the insurance company will provide the compensation for you
Well go back to insurance issue.


By now, we have taken a good note of more insurance requirement and will pay close attention to buy one more insure for inland transportation insurance for you, since you have a special need for inland transportation care.
 


For us, we do business for 30 years and never met this situation before. Had you met this situation before?
 


For all of our partners, we all buy all risks for them and never ever think that in their local country there is such a special thing happen. We are in a grate astonished for this situation as well.
 


We are afraid that it is too late to be brought into current on hand order PI#971208. So turning now to this order, we have  a chance to correct the mistake. At any rate, please let us to do more for this order to nip in the bud. Both of our companies have existed in a harmonious way in the past, and we wish it to remain the same in the days to come.
 


It’s a slight suggestion for you. Would you please check with the insurance company at you end regarding what’s the best and suitable insurance for you? You can deal with the insurance company at your side for a best solution.
 


Moreover, we would like to ask, will you make a final decision to buy this merchandise PI#971208? Should we go on producing this merchandise?? Since now, we cannot buy colorful boxes and make a final agreement for this order.


There may have a slight delay for this merchandise caused by the pending for colorful boxes, freight and insurance. Hope you can understand.
 


We will discuss this issue with my boss again when he comes back from the U.S.A. Please
kindly wait for a while.
 


Attached files are incoterm for
CIF & DDU for your reference. The term what we engage within each other is CIF but it seems that you are talking about DDU term. When you study the policy for CIF more detail then you will know what role you are taking responsible for.
 


To sum up and emphasis again, we are in your hands, and we know that you will do the right thing for both of us in this complaint. We are certain that both of us can continue a mutually pleasant and profitable association. Kindly show your concurrence with us in the above modest arrangement.

看來這個哥哥不太知道CIF的定義,所以只能將ICOTERMS 2000中原版的條規付給他看,明明就只有海上和陸上的水運有賠,可是真不知該怎麼讓他們接受自己吃下這筆虧 ....


保險公司說在中南美洲貨在陸運上被偷是很正常的除非買方也就是乙方自己加保內陸運輸險...,我也知道這樣跟客人說他們只會不爽家三級 = 超級不高興更是有可能直接斷絕往來,因為這樣就擺明了說他們國家的治安不好.....誰會喜歡自己的國家備說治安不好??


所以就只好一邊翻書一邊想要怎麼解決才能達到雙方都能接受的大圓滿結局....
要很感謝曾保老師的工商應用英文和我曾經在貿易教育基金會上過曾老師課用的課本和財產保險業員基本教運訓練教材"運輸保險"陪伴了我度過這段傷腦筋的時光!
